ScheduleUX is built by a small team and represents hundreds of hours of work. This agreement is meant to protect and indemnify ScheduleUX and the individuals responsible for designing, developing, managing, and financing ScheduleUX.
It is our goal at ScheduleUX to promote 'User Research' by making scheduling easier and less painstaking. These terms of service are intended to protect our ability to provide this service to our users. In holding with our goals, it is a basic requirement for us at at ScheduleUX to "protect ourselves" from "bad actors" and people or individuals who would attempt to compromise our service, security, or financial viability.
ScheduleUX was designed to streamline the process of scheduling participants for "supervised" Usability Studies and User Interviews.
There are many options for creating "unsupervised" user research and studies (studies where a researcher does not directly oversee each session nor engage with participants during the sessions); ScheduleUX is not intended to be used to schedule or manage "unsupervised" studies.
In general, each individual person using ScheduleUX is expected to have their own account. In practice, we recognize that a "team" of researchers will benefit most by being able to collaborate on creating, editing, scheduling, and reviewing studies.
By accessing the website at http://ScheduleUX.com, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.
None of the additional statements in this section change that fact; The following statements have been included for the sake of clarifying our intent and establishing "reasonable expectations" around what parameters we consider 'excessive'.
These guidelines are designed in such a way that any user acting "in good faith" should never run into a situation where their use could be considered 'excessive'. ScheduleUX is designed to take the "headache" out of scheduling user research, and we will stay out of your way unless we feel we have legitimate concerns that your account may be compromised or that your account is being used for illicit purposes. If we are concerned about your usage, we will follow our Resolution Steps.
At the time of writing, our expectation is that 'excessive use' will likely include one of the following issues:
It is acceptable for a "team" of researchers to share an individual account with the expectation that the "team" is composed of a small number of individuals (2-5 is reasonable; more than 8 is excessive) who share responsibility for preparing, documenting, conducting, or auditing the same research studies. If you are collaborating on studies, sharing an account is acceptable for the studies you are collaborating on. If you are running studies independently, it's expected you will have separate subscriptions for each researcher who runs studies on their own or as part of a separate group.
Our approach to resolution will depend on the type and severity of the issue.
You will not be refunded in whole or part for any time your account is suspended as a result of or in response to an "Emergency". Determination of the whether an issue is an "Emergency" is at the sole discretion of ScheduleUX and representatives, but we will always consider an issue an "Emergency" in any of the following circumstances:

In the unlikely event that we believe there may be an issue with your account, we will do the best we can to contact you so that we can resolve the issue before it becomes an "emergency".
In no event shall ScheduleUX or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on ScheduleUX's website, even if ScheduleUX or a ScheduleUX authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
